Millfield Overstrand Ltd: Lessee "Regulations"

These Regulations are in effect the Second Schedule of the original Lease Agreement. All new Lessees or sub-tenants are provided with a copy and asked to sign them as an undertaking. The reason for this is to draw attention to a common-sense set of standards which we impress on everyone living here - very much for the mutual benefit of all. Obviously living in apartment buildings calls for a modicum of mutual respect for one's neighbour.

Millfield Overstrand Limited Regulations: Applicable Under the Terms of Your Lease

Under Clause 2(14) of the Lease all Lessees have covenanted to perform and observe the Regulations as set forth in the Second Schedule which is now duly revised and notified as Clauses 1-19 below. Under 2(14) the Board as ‘Lessor’ has authority to do this. The purpose of these Regulations is to maintain the excellent quality of living that we have, and wish to continue to have, on the Estate. They apply to all permanent and temporary residents whether a Lessee, Tenant or visitor to the Estate (references to 'residents' below shall be construed accordingly).

Please read this notice carefully as it applies to everyone in residence or visiting the Estate. Lessees/owners are duty bound to make Tenants and visitors using the estate aware of these regulations as necessary.

Change of Residency: Sale of a Property:

The Lessee shall provide Millfield Overstrand Limited with contact details of the solicitor negotiating the sale in order that the required documents can be requested and obtained to enable the ‘Consent to the Assignment of the Lease’ and a replacement Change of Residency Share Certificate will be granted to new Lessees.

Sub-letting:

No Lessee shall sub-let their flat without FIRST obtaining the written consent of the Lessor. The managing agent (Hobdens Property Management, (Hobdens) 41a Beach Road, Littlehampton BN17 5JA - telephone number 01903 724040,) should be contacted when consent is required and further details will be provided. NB: The Renters Rights Act has now received Royal Assent and when details are available, if necessary, this document will be updated.

Safeguarding and Security:

For the safety and security of all individuals within estate buildings, both front and rear security doors must remain shut at all times except when taking heavy objects in or out or cleaning is taking place. The tradesman entry on front door keypads is set to allow access between 7am and 6pm.

Tidiness and Appearance (Internal & External):

No clothing, bedding, mats, towels etc should be left on balconies or patios for drying or any other purpose. Every effort must be made to ensure washing is not visible from outside the property, i.e. at least one metre inside property. Balconies and patios should be kept tidy and free from domestic waste or debris. Residents should ensure that the drainage outlets to individual balconies are kept free of debris. Damage caused by neglect will be at the Lessees expense.

Personal possessions such as garden furniture, children's toys, bicycles, scooters, inflatables etc should be kept neatly in the immediate vicinity of the owner's flat by day and removed inside at night. Do not allow them to be left outside hallway entrances, or within hallways where they could cause an accident, this includes drying washing on stairway bannisters and on clothes airers. No goods or storage boxes etc are to be placed anywhere other than on your patio or inset balcony. Patios & ground floor inset balconies cannot be extended into the estate common area for any reason.

For fire safety reasons BBQs are not allowed on balconies or anywhere on the site. As a reminder, smoking/vaping is not permitted in the common ways/stair cases.

Refuse:

All domestic rubbish must be put into suitable refuse bags and securely tied before placing in the appropriate wheelie bins. Recyclable refuse must be deposited loose in the relevant refuse bin. No loose unbagged items should be left on the bin room floors. Cardboard boxes etc must be broken up to fit into the bins or other packaging should be collapsed and bundled otherwise the refuse collectors may refuse to take them; in which case it is the owner's/Tenant’s responsibility to ensure their correct disposal. Only approved recyclables should be placed in the relevant wheelie bin, as detailed on the recycling bins or Arun District Council Website.

Noise:

Residents must be considerate of neighbours and not make excessive noise. In particular, radios (including car radios), televisions and musical instruments should not be audible to neighbours, particularly between 11pm and 7am. Avoid banging doors, especially at night. Residents must be considerate when in the garden, common parts, using patios or balconies, especially in the evening or at unsocial times.

Children:

Residents and visitors are asked to keep their children under control and supervised at all times and they should not be allowed to enter the flower beds. Children are not permitted to play in any part of the common ways (stair cases).

Ball games:

Ball games are not allowed within the perimeter of the Estate.

Use of Cycles & Scooters:

Although it has been customary to allow young children to use bicycles and tricycles on the estate paths this can no longer be sanctioned by the Lessor due to safety regulations. You are therefore advised that any accident arising from the use of cycles is entirely the responsibility of the cyclist or cyclist's parent or guardian. The Lessor has no jurisdiction over the Council owned tarmac pavements of Overstrand Avenue and Millfield Close but it is pointed out that cycling is prohibited on all Council pavements.

Cycling on the council owned roads on the estate will be subject to the appropriate Road Traffic Acts and applicable byelaws and other legislation. Mobility Scooters are excluded from these restraints however; residents and visitors must use them with care. Cycles, including electric cycles, must not be stored or charged in the common ways (stair cases).

Boundary Walls:

Do not climb on or over the Estate boundary walls, gates for accessing the sea front. Should any person be injured, due to their own actions, they are responsible for those injuries. If damage is caused by individuals climbing over the boundary walls, repairs will be at a cost to those concerned.

Dogs:

All dogs must be kept on a short lead and under control at ALL times when on the Estate and must not be allowed to foul the lawns, paths or flower beds. A dog is deemed to have fouled when the owner fails to pick up the faeces immediately. Residents must also ensure that dogs do not cause a nuisance to other residents in anyway this includes continual barking.

Common ways/stair cases:

No personal items are to be left in any part of the common ways, these areas must be kept clear at all times due to fire safety regulations. Both front and rear security doors should remain shut at all times except when taking objects in or out. Common way windows may be opened to obtain fresh air but should be shut at night. The person who opens the window is responsible for its closure at night time.

Vans, Caravans, Campervans, Trailers and Boats:

Residents' vans, caravans, campervans, trailers and boats must not be left in the parking bays. The parking bays are intended for residents' and visitors' cars only, and must display a valid authorised parking permit. No cars that have been declared SORN (with the DVLA) are to be left in a parking bay. Tradesmen's vans, with an estate pass, may be parked in the parking bays whilst work is in progress but must not be left overnight.

Garages and Car Cleaning/Repairing:

Only motorcars, motorcycles, mobility scooters or bicycles/tricycles, trailers and recreational equipment, shall be kept in a garage. No garage shall be used primarily as a store. Lessees are responsible for the repair and replacement of their garage door and surrounding frame.

No dismantling or repairs should be carried out to any vehicle on any common part of the Estate, other than in an emergency. No vehicle shall be washed except in the garage lane compound where water is provided, where there is proper drainage for waste water and where no obstruction will be caused. Any work carried out to cars within the garages must be to Lessee's own vehicles only. Garage doors and frames must be kept in serviceable condition and painted white.

Water and Gas Supply Systems and Electric Wiring:

Consent is required to make any changes to water, gas and/electric supply service media that does not exclusively serve the demised premises and is not entirely internal to the demised premises (with no consent being needed for changes carried out in order to comply with statutory safety-related requirements). Such consent shall not be unreasonably withheld. Any damage to exterior brickwork or tiles during such installations must immediately be professionally reinstated, such as fitting boiler flues and fans. Non-compliance will result in the Lessor authorising the work to be carried out and the relevant Lessee will be charged accordingly.

You are strongly advised that when vacating your flat to turn off the main water supply, particularly in the winter and it is a condition of our Buildings Insurance to do so. This is primarily to avoid leaking overflow pipes and the possibility of water leaking from mains connected equipment such as washing machines, dishwashers etc.

Feeding of Birds:

Residents must refrain from feeding birds particularly seagulls and crows on the estate. There is a risk of injury to small children from the seagulls, encourages vermin, increases damage to television aerials and the soiling of windows.

Maintenance and Replacement Doors and Windows:

The Lessor, via Hobdens, must be notified in advance and prior to any replacement. Lessees must submit contractors plans and specifications if any they intend to replace existing external doors or windows; this includes patio and bifold doors and receive consent from Hobdens. Where replacements are made you are most strongly advised to ensure that any damp proof courses or lead trays are in good condition, or as a matter of course are replaced. Any consequent water ingress associated with these structures is excluded under the building insurance policy and will NOT be covered by the maintenance fund. Lessees are encouraged to have their windows and frames cleaned regularly.

Garage doors and their direct frames are the responsibility of Lessees and should be kept clean and in good condition in accordance with the lease.

Television Aerials and Satellite Dishes:

No Lessee/Tenant shall fix a wireless, television or satellite aerial to the exterior of the property. Only Millfield Overstrand Limited's television aerial contractor is authorised to deal with any aerial or satellite television (SKY) connection matters. The external elevations are part of the Estate and nothing should be fixed without express consent and this includes key boxes.

Key boxes can only be fitted following authorisation, via Hobdens, for the purpose of access for carers or medical needs.

Businesses:

Properties are exclusively for residential purposes, although working from home and undertaking office and admin tasks is acceptable. No trade or business involving clients calling and/or the storage of goods for the purpose of resale or the provision of services to the public for profit may be stored or traded on the premises, including garages.

Advertising:

No estate agent posters, boards, or any notice shall be displayed at the property.

Interpretation and Observance of the Regulations:

As with any regulations you may feel clarification as to the meaning of certain clauses are needed from time to time, in which case further clarification can be sought and initial contact should be made, via Hobdens. If you feel that another Resident is unreasonably ignoring the sense, spirit and purpose of the Regulations you should in the first instance make all endeavours to discuss the problem diplomatically and directly with the person(s) concerned. It is far more satisfactory, if possible, to resolve such issues amicably before drawing it to the Board's attention.

If the matter cannot be resolved then you should advise the Chairman of the Board, via Hobdens, in writing with all relevant details.

PLEASE REMEMBER THESE REGULATIONS ARE TO SAFEGUARD YOUR INVESTMENT AND PROTECT YOUR RIGHT TO USE AND ENJOY THE ENVIRONMENT OF THE ESTATE.

Directors will review these Regulations at least every 3 years or when legislation changes.
